    WASHINGTON — The Justice Department has concluded that the Obama administration can lawfully pay the community group Acorn for services provided under contracts signed before Congress banned the government from providing money to the group.
     The department’s conclusion, laid out in a recently disclosed five-page memorandum from David Barron, the acting assistant attorney general for the Office of Legal Counsel, adds a new wrinkle to a sharp political debate over the antipoverty group’s activities and recent efforts to distance the government from it.
    Since 1994, Acorn, which stands for the Association of Community Organizations for Reform Now, has received about $53 million in federal aid, much of it grants from the Department of Housing and Urban Development for providing various services related to affordable housing.
    But the group has become a prime target for conservative critics, and on Oct. 1, President Obama signed into law a spending bill that included a provision that said no taxpayer money — including money authorized by previous legislation — could be “provided to” the group or its affiliates.
    A Housing and Urban Development Department lawyer asked the Justice Department whether the new law meant that pre-existing contracts with Acorn should be broken. And in a memorandum signed Oct. 23 and posted online this week, Mr. Barron said the government should continue to make payments to Acorn as required by such contracts.
    The new law “should not be read as directing or authorizing HUD to breach a pre-existing binding contractual obligation to make payments to Acorn or its affiliates, subsidiaries or allied organizations where doing so would give rise to contractual liability,” Mr. Barron wrote.
    The deputy director of national operations for Acorn, Brian Kettenring, praised Mr. Barron’s decision.
    “We are pleased that commitments will be honored relative to Acorn’s work to help keep America’s working families facing foreclosure in their homes,” Mr. Kettenring said.
    Mr. Barron said he had based his conclusion on the statute’s phrase “provided to.” This phrase, he said, has no clearly defined meaning in the realm of government spending — unlike words like “obligate” and “expend.”
    Citing dictionary and thesaurus entries, he said “provided to” could be interpreted as meaning only instances in which an official was making “discretionary choices” about whether to give the group money, rather than instances in which the transfer of money to Acorn was required to satisfy contractual obligations.
    Since there are two possible ways to construe the term “provided to,” Mr. Barron wrote, it makes sense to pick the interpretation that allows the government to avoid breaching contracts.
    Moreover, he argued, requiring the government to cancel contracts with a specifically named entity — “including even in cases where performance has already been completed but payment has not been rendered” — would raise constitutional concerns best avoided by interpreting the law differently.
    The Constitution prohibits “bills of attainder” — legislation intended to punish specific people or groups. Acorn has filed a lawsuit arguing that the statute banning the government from providing it money amounts to a bill of attainder.
    Founded in Arkansas in 1970, Acorn describes itself as the nation’s largest grass-roots community organizing group. It provides financial services to poor and middle-income families, conducts voter registration drives, and advocates for higher minimum wages and more affordable housing.
    Conservatives have long complained about Acorn’s voter drives in poor neighborhoods, citing instances in which workers fraudulently registered imaginary voters like Mickey Mouse. Acorn has argued that it is the real victim of such incidents, which its employees have often brought to the attention of the authorities.
    Criticism of Acorn escalated in September, when two conservative activists released videos they had recorded using secret cameras of Acorn workers in several cities. The activists had posed as a pimp and a prostitute seeking financial advice. Instead of raising objections, the Acorn employees counseled the couple on how to hide their illicit activities and avoid paying taxes.
    Conservatives seized on the videos to criticize the group further, highlighting that the Obama campaign had paid an Acorn affiliate for get-out-the-vote efforts. Congress then enacted the ban on providing money to it.
    Acorn has fired several of the employees depicted in the videos.

Cu dorinţa nesăbuită de înavuţire şi căpătuire. Cu aceste zdrenţe ca în aproape 20 de ani nu au făcut decât să se căpătuiască. Au privatizat şi vândut totul cu nişte profituri uriaşe.
    Avem miliardari în euro...pe sudoarea noastră de babini docili şi mămăligari. Miliardari de cacao care s-au ajuns în atât de puţini ani. Şi pe ce s-au căpătuit, păi pe trădarea faţă de ţară pe propriile afaceri făcute în detrimentul ţării. Şi este oare cineva nevinovat din această clasă gingaşă ? Unde sunt mari corupţi ? Cum de numai funcţionează nimic în Romănia ?
    Comuniştii, Ceauşescu au distrus România, bine tot cu acordul "aliaţilor" europeni care ne-au lăsat pe mâna ruşilor. Totuşi după executarea lui Ceauşescu rămăsese în ţară o agricultură şi industrie la un nivel de la care s-ar fi putut pleca cu succes. În unele dominii aveam chiar mari relizări. Iar...acum aceste lăcuste înfometate ce-au făcut ?


    In 20 de ani nu s-a aflat nimic de criminalii care au tras în noi după 22 decmbrie 1989.
    Crminalul Iliescu şi ceilalţi sunt liberi...după toate crimele comise o dată cu chemarea minerilor.

    Toate aceste mârşăvii arată că, comunismul a trecut printr-o metamorfoză...de catifea şi a ajuns tot comunism.

    Dar mai este ceva, care este mai marşav decât totul, şi anume că interesele României nu sunt respectate. Unele sunt greşeli de incopetenţă...dar multe sunt intenţionate pentru asigurarea unor avantaje.
    Avem guverne incompetente ce garantează din ce în ce mai mult prăbuşirea.

    Avem "cujetători" ce dau din ce în ce mai mult un sens filozofic prostiei.


    În toată această confruntare n-am văzut pe nimeni să aibă seriozitate momentului în cel de-al XII-lea ceas.

    Avem un preşedinte un guvern şi un parlament care dând vina unii pe alţii, certându-se ca nişte neghiobi. Iar economia ţării, pe care acelaşi preşedinte dar cu alt guvern afirmanu că “economia duduie”, este aproape în colaps.
    Nimic şi de nimeni nu s-a făcut pentru lansare sau pentru încercare lasării economiei.


    Intrarea în Europa a fost pentru România o afacere pentru clasa politică şi deci nimic bun pentru România. Au fost trimişi la Brusseles pentru negocieri tot felul de idioţi şi nepregătiţi care şi-au bătut joc de ţară. Europenii “rîdeau”, ei negociau serios cu nişte fripturişti.


    Nu mai vorbesc de toată industria unde aveam şi unicate în domeniu a fost distrusă…parcă la cerere. De agricultura acestei ţări aşa bogate nu mai produce pentru că alţii ne fac legi în ţară, iar aceşti vânduţi sunt cooperanţi distrugerii.
    Dar aceştia sunt politicenii pe care vreţi să-i votaţi.

    În toată această mascaradă atât de mediatizată, şi acest schimb de replici de genul : “Hoţii noştri sunt mai puţini hoţi ca ai voştri” ; “Voi minţiţi cu neruşinare, noi ştim adevărul”.
    Oare câştigă România, imaginea ţării, nicidecum. Dar cui oare îi mai pasă de ţară ?


    Romania este o ţară ortodoxă, o ţară în care cu toate că, comuniştii au vrut s-o distrugă complet, n-au reuşit, mai mult, prin rău pe care l-au făcut, au dat ţării martiri şi mucenici ai neamului. Biserica Ortodoxă este mai atacată ca oricând, iar garantul nostru ales, peşedintele ţării, se închină şi face pe credinciosul numai de ochii lumii în vederea alegerilor, bine la fel ca şi celelalte panarame. L-am văzut pe Iliescu şi pe Gioană la Biserică...eh ! câtă marşavie şi câtă prefecătorie.


    Dacă ar fi fost un preşedinte care ar fi ţinut cont că România este o ţară ortodoxă, n-ar fi fost deacord cu căsătoria între homoxesuali şi nu ar ar fi fost deacord cu legalizarea prostituţiei şi a drogurilor…uşoare.
    Acesta nu poate fi un preşedinte pentru o ţară ortodoxă.

    Parintele Părvu, a strâns peste un million de semnături impotriva microcipurilor. S-a ajuns la preşedinte…şi poate cei peste un million de cetăţeni ar fi aşteptat un răspuns.

    Geoană, Iliescu, Patriciu…Hrebenciucul cu muştar, Cosmârca de munte, toate aceste personaje janice se pretează la orice. Le cunosc mitocănia şi felul mârşav de acţiona.

    Iar acum…eu vă întreb ceva, voi chiar sunteţi orbi, nu vedeţi cu ce hiene aveţi de-a face ? Voi nu vedeţi că de voi se folosesc acum, iar pe urmă o să trateze…ca pe nişte viermi ?

    While I am not an attorney or Judge, nor do I play one on television, I am a long time student of the Constitution.  My position is that of an "Originalist", in that I believe that the Constitution says what it means, and means what it says, that little if any "interpretation" is necessary beyond that of the words of the men who wrote it.

    In that vein, I am currently working with a couple of Civics groups teaching them about the Constitution and what the men who wrote it meant for our nation when they wrote it, so if any of you have any questions, or issues that you'd like to bring up, go for it and we'll see where they take us.

    Justice Department Questions Retroactive Ban on Federal Funds to ACORN

    The Justice Department’s Office of Legal Counsel this week posted a legal opinion saying that the Obama administration may continue paying the Association of Community Organizations for Reform Now (ACORN) for contracts signed before Congress in September passed -- and President Obama in October signed -- legislation banning federal funds from going to ACORN.
    The opinion was written on Oct. 23 by Acting Assistant Attorney General David Barron in response to a request for clarification from the deputy general counsel for the Department of Housing and Urban Development as to the full meaning of the legislative language, which states, "None of the funds made available by this joint resolution or any prior Act may be provided to the Association of Community Organizations for Reform Now (ACORN), or any of its affiliates, subsidiaries, or allied organizations."

    Barron said the language could be interpreted "categorically to prohibit any outlay of money to the identified entities, including pursuant to pre-existing contractual obligations," but, "one could also read the phrase not to prohibit payments made pursuant to a prior binding contractual duty."
    Because of this perceived ambiguity, Barron concluded that the law "should not be read as directing or authorizing HUD to breach a pre-existing binding contractual obligation to make payments to ACORN or its affiliates, subsidiaries or allied organizations where doing so would give rise to contractual liability."
    The federal government has given more than $50 million to ACORN since 1994, much of it in the form of HUD grants.
    The ranking Republican on the House Committee on Oversight and Government Reform, Rep. Darrell Issa, R-Calif., blasted the DOJ opinion as "political cronyism."
    “The bipartisan intent of Congress was clear – no more federal dollars should flow to ACORN," Issa said. "It is telling that this administration continues to look for every excuse possible to circumvent the intent of Congress.  Taxpayers should not have to continue subsidizing a criminal enterprise that helped Barack Obama get elected president.  The politicization of the Justice Department to pay back one of the president’s political allies is shameful and amounts to nothing more than old-fashioned cronyism.”   
    The Justice Department opinion comes at the same time as a lawsuit filed by Center for Constitutional Rights on behalf of ACORN saying the ban is unconstitutional. (Read that lawsuit HERE.)
    Article I, Section 9, cl. 3 of the Constitution of the United States "is one of the crown jewels of the founding instrument of our nation. It explicitly provides that 'No bill of attainder of ex post facto law shall be passed,'" the suit says, alleging that the lawsuit denied ACORN due process of law. "Congress has adjudged ACORN guilty of the allegations of fraud, misconduct and other illegal conduct."
    The suit alleges that the legislation "reveals a malicious and punitive intent against, and a singling out of the plaintiffs that arises from the heavily funded and orchestrated political campaign against the plaintiffs." The suit says that "ACORN has been penalized by Congress without an investigation. ACORN was never even the subject of a hearing in Congress."
    It praises ACORN, saying the group has helped more than two million people to register to vote, has helped more than 150,000 file their tax returns, and has "worked on thousands of issues that arise from the predicaments and problems of the poor, the homeless, the underpaid, the hungry and the sick."
    The CCR suit notes that "[d]espite numerous press reports and congressional, independent, and other governmental investigations of many other scandals involving serious misconduct such as fraud or corruption among government contractors, some of which involved corporations which were convicted of serious crimes, Congress has thus far enacted no laws singling out for suspension of debarment any government contractor, other than the plaintiffs."
    As you may recall, following videotapes filmed furtively by conservatives showing ACORN employees offering to help a purported pimp and prostitute participate in crimes, on Sept. 11 the Census Bureau announced it was severing ties with ACORN, which bills itself as “the nation's largest community organization of low and moderate income families.”
    Not long afterwards, the Senate voted overwhelmingly to prohibit HUD grants from going to the group.  On Sept. 16, White House press secretary Robert Gibbs assailed ACORN, saying, "obviously the conduct you see on those tapes is completely unacceptable. ... The administration takes accountability extremely seriously."

    Climategate: five Aussie MPs lead the way by resigning in disgust over carbon tax

    Australia is leading the revolt against Al Gore’s great big AGW conspiracy – just as the Aussie geologist and AGW sceptic Professor Ian Plimer predicted it would.
    ABC news reports that five frontbenchers from Australia’s opposition Liberal party have resigned their portfolios rather than follow their leader Malcolm Turnbull in voting with Kevin Rudd’s Government on a new Emissions Trading Scheme.
    The Liberal Party is in turmoil with the resignations of five frontbenchers from their portfolios this afternoon in protest against the emissions trading scheme.
    Tony Abbott, Sophie Mirabella, Tony Smith and Senators Nick Minchin and Eric Abetz have all quit their portfolios because they cannot vote for the legislation.
    Senate whip Stephen Parry has also relinquished his position.
    The ETS is Australia’s version of America’s proposed Cap and Trade and the EU’s various carbon reduction schemes: a way of taxing business on its CO2 output. As Professor Plimer pointed out when I interviewed him in the summer, this threatens to cause enormous economic damage in Australia’s industrial and mining heartlands, not least because both are massively dependent on Australia’s vast reserves of coal. It is correspondingly extremely unpopular with Aussie’s outside the pinko, libtard metropolitan fleshpots.
    Though the ETS squeaked narrowly through Australia’s House of Representatives, its Senate is proving more robust – thanks not least to the widespread disgust by the many Senators who have read Professor Plimer’s book Heaven And Earth at the dishonesty and corruption of the AGW industry. If the Senate keeps rejecting the scheme, then the Australian government will be forced to dissolve.
    For the rapidly increasing number of us who believe that AGW is little more than a scheme by bullying eco-fascists to deprive us of our liberty, by big government to spread its controlling tentacles into every aspect our lives, and scheming industrialists such as Al Gore to enrich themselves through carbon trading, this principled act by Australia’s Carbon Five is fantastic news.
    Where they lead, the rest of the world’s politicians will eventually be forced to follow: their appalled electorates will make sure of it.

    Drivers of all ages must do a better job


    I am only 18, and to most an inexperienced driver, but when I’m on public streets what I see is ridiculous. Not only young drivers, but middle-aged and senior citizen drivers act stupidly on the roads. From people driving on the side of the road to speeding up trying to catch the yellow light, every day it seems that people’s driving worsens, especially around construction sites and emergency vehicles and personnel.


    As an active volunteer firefighter, I often carry and use a blue light. Although blue lights do not allow the vehicle to bypass traffic laws, nobody knows what’s on the other end of that call. Every minute is highly valuable in an emergency situation, and when I get stuck behind someone who refuses to let me pass, those extra couple minutes could cost someone his or her life.


    Construction sites are also risky areas, especially with careless drivers. Many people are working close to, if not in, the streets and when drivers speed by it creates a very hazardous zone. If drivers could just slow down and watch what they are doing, fewer accidents and injuries would result.

  • Oz’s finances shown in opposite extremes

    An attorney who sued the promoters of the proposed Wizard of Oz theme park on behalf of an unpaid contractor said this week that as far as he can tell, the man behind the curtain has empty pockets. Despite that, the town’s lame-duck supervisor, Timothy E. Demler, asserted that Oz Central, as the company is known, is about to come up with $3 billion in private investment and an additional $1 billion in bank loans to build the giant project. Color Marc W. Brown skeptical.
    He’s an attorney with the Phillips Lytle firm who has subpoenaed Oz Central’s bank records in an effort to find enough cash to pay court judgments against the company totaling $105,000 on behalf of a local engineering firm.
    “We are entitled to receive any information about what their financial situation is,” said Brown, who represents Nussbaumer & Clarke, a company that Oz hired to perform a traffic study.
    The verdict: Oz doesn’t seem to have enough to pay that judgment, never mind $4 billion.
    Oz Chief Executive Officer Richard A. Burch acknowledged as much in a June 15 court affidavit filed after Oz paid Nussbaumer & Clarke $400, “which was what Oz could afford to remit at that time, as Oz is an entity that has no cash and is otherwise destitute.”
    In September 2008, Nussbaumer & Clarke won a judgment against Oz for $99,490 in unpaid bills for the study. That hasn’t been paid.
    State Supreme Court Justice John M. Curran also ordered Oz to pay the contractor’s legal fees and court costs.
    Burch, who did not return calls this week, sought to pay the judgment in installments. Brown said that given Oz’s track record, he refused.
    Another Buffalo engineering firm, URS Corp., won a $147,143 judgment against Oz from State Supreme Court Justice Richard C. Kloch Sr. last December. URS executives did not return calls this week, but there was nothing in the court file to indicate that the money was paid.
    According to court papers, Oz is being represented by former U. S. Attorney Michael A. Battle, who is now practicing law in Washington. He also did not return calls seeking comment.
    Demler said he still believes in Oz Central’s project, as he has for the last five years.
    “I think it’s more close than [critics] know,” Demler said. “I’m pretty optimistic.”
    He said three-quarters of the $4 billion cost of the plan would come from private investors and the rest from banks.
    Asked how a destitute company could hope to receive $1 billion in bank loans during a credit crunch, Demler answered, “Because they got three-quarters of it privately.”
    Brown said Burch did not say anything about having that kind of money during his deposition. “Anything that is in their hands should be recoupable [for the creditors],” the attorney said.
    Supervisor-elect Robert B. Cliffe said he met with Burch and his associates before the election, but not since.
    “It’s a massive project. It’s the kind of project Western New York could use,” Cliffe said. “If and when it breaks, we’ll be ready. They seem to be good people.”

    What most people know is that the Associated Press (AP) is one of the largest, internationally recognized, syndicated news services.  What most people don’t know that is in 2004, the AP was a “birther” news organization.

    This report explains the context of the oft cited debate, between Obama and Keyes in the following Fall, in which Keyes faulted Obama for not being a “natural born citizen”, and in which Obama, by his quick retort, “So what? I am running for Illinois Senator, not the presidency”, self-admitted that he was not eligible for the office.  Seeing that an AP reporter is too professional to submit a story which was not based on confirmed sources (ostensibly the Obama campaign in this case), the inference seems inescapable: Obama himself was putting out in 2004, that he was born in Kenya.

    The difficulty in finding this gem of a story is hampered by Google, which is running flak for Obama:  because if you search for “Kenyan-born US Senate” you won’t find it, but if you search for the phrase without quotes you will find links which talk about it.

    Donovan says the Secret Service first learned about the security breach Wednesday morning after media inquiries prompted by the crashers' online boasts about having attended the private event.
    The Washington Post reports that photos from the state dinner appear on the Facebook page of one of the dinner crashers.

    Starting this morning the EZ Pass zone tells me I need to "call" them.  Credit card is up to date.  I've never sped through one of their man-bitch toll booths.  I know they take pics of me every time I cross the GI bridge, but would they be able to capture a picture if I accessed the bridge on foot from the bike path and beat the living shit out of the control unit with a 34" Easton?  A few of the human space-cases that occupy the non-EZ Pass lanes are welcome to intervene if they have a curiosity of the after-life.

  • Hidden Surveillance in your living room!

    This is going to be a real experiment into claims that the government is using the digital cable to spy in on the living rooms of American people.  There are claims that the converter box for digital cable in your home is wired with a camera and mic and that they can receive and record this information.  I personally  don't see the logic behind this as of right now.  Unless they are spying on suspected terrorists and in that case what stops them from spying on whoever they wish.  Anyway to put my curiosity to rest I will be taking apart my cable company's digital box tonight.  I am going to be taking pictures and posting them as well.  I am actually hoping to find something this would be very interesting if I did.  I have been told that if your tv is digital that there could also be a camera and mic in that also.  If I do find something I might take apart my tv also.  I just want to see if our government or the big businesses think that nobody will find there hidden hardware if there is any.  I have read many private posts about this and people that have claimed to tear one down but no pics and nothing to back their claims I am going to post evidence if or if not I find anything.  Anyway keep an eye on this and hopefully I will have everything together by morning.  I am going to attempt to hack the device also I know that my cable company has a connection port inside of the box as I have seen this.  I also know what type of connection it has with any luck I'll be able to connect and get some info that way if there is no clear evidence of mic or camera.

    “Two top Democrats say they want to impose a new tax on the wealthy to finance any increase in U.S. troops for the Afghanistan war. 
    Rep. David Obey, D-Wis., chairman of the purse string-controlling House Appropriations Committee, is calling the idea a “war surtax.” He said that just as the federal government is expected to pay for its proposed intervention in the health care sector with new taxes, any escalated involvement in Afghanistan should come with a payment plan. 
    “If we have to pay for the health care bill, we should pay for the war as well … by having a war surtax,” Obey told ABC News in an interview that aired Monday. “The problem in this country with this issue is that the only people that has to sacrifice are military families and they’ve had to go to the well again and again and again and again, and everybody else is blithely unaffected by the war.” 
    Sen. Carl Levin, chairman of the Senate Armed Services Committee, is making a similar demand. 
    President Obama plans to hold his ninth meeting Monday evening with his national security team to discuss options for overhauling the strategy in Afghanistan. The president has been considering requests for tens of thousands more U.S. troops from his top commander, Gen. Stanley McChrystal, for nearly three months. He is not expected to announce his new strategy before Thanksgiving. 
    But any request would likely come with a hefty price tag. One option presented by McChrystal would bring 40,000 more troops into Afghanistan — a proposal estimated to cost about $40 billion, according to the Office of Management and Budget. 
    Obey said if an increase like that is approved without any payment mechanism, then other domestic initiatives would be wiped out. ”

  • Not-So-Safe-Deposit Boxes: States Seize Citizens' Property to Balance Their Budgets

    The 50 U.S. states are holding more than $32 billion worth of unclaimed property that they're supposed to safeguard for their citizens. But a "Good Morning America" investigation found some states aggressively seize property that isn't really unclaimed and then use the money -- your money -- to balance their budgets.

    Unclaimed property consists of things like forgotten apartment security deposits, uncashed dividend checks and safe-deposit boxes abandoned when an elderly relative dies.

    Banks and other businesses are required to turn that property over to the state for safekeeping. The problem is that the states return less than a quarter of unclaimed property to the rightful owners.

    Not-So-Safe-Deposit Boxes

    San Francisco resident Carla Ruff's safe-deposit box was drilled, seized, and turned over to the state of California, marked "owner unknown."

    "I was appalled," Ruff said. "I felt violated."

    Unknown? Carla's name was right on documents in the box at the Noe Valley Bank of America location. So was her address -- a house about six blocks from the bank. Carla had a checking account at the bank, too -- still does -- and receives regular statements. Plus, she has receipts showing she's the kind of person who paid her box rental fee. And yet, she says nobody ever notified her.

    "They are zealously uncovering accounts that are not unclaimed," Ruff said.

    To make matters worse, Ruff discovered the loss when she went to her box to retrieve important paperwork she needed because her husband was dying. Those papers had been shredded.

    And that's not all. Her great-grandmother's precious natural pearls and other jewelry had been auctioned off. They were sold for just $1,800, even though they were appraised for $82,500.

    "These things were things that she gave to me," Ruff said. "I valued them because I loved her."

    Bank of America told ABC News it deeply regrets the situation and appreciates the difficulty of what Mrs. Ruff was going through. The bank has reached a settlement with Ruff and continues to update its unclaimed property procedures as laws change.

    California's Class Action Lawsuit

    Ruff is not alone. Attorney Bill Palmer represents her and countless other citizens in a class action lawsuit against the state of California.

    "They figured the safety-deposit box was safer than keeping it under the mattress," Palmer said. "In the case of a lot of citizens, they were wrong, weren't they?"

    California law used to say property was unclaimed if the rightful owner had had no contact with the business for 15 years. But during various state budget crises, the waiting period was reduced to seven years, and then five, and then three. Legislators even tried for one year. Why? Because the state wanted to use that free money.

    "That's absolutely correct," said California State Controller John Chiang, who inherited the situation when he came into office. "What we've done here over the last two decades has been dead wrong. We've kept the property and not provided owners with the opportunities -- the best opportunities -- to get their property back."

    Chiang now faces the daunting task of returning $5.1 billion worth of unclaimed property to people. Some states keep their unclaimed property in a special trust fund and only tap into the interest they earn on it. But California dumps the money into the general fund -- and spends it.

    "It's supposed to be segregated and protected," Palmer said. "California has taken all of that $5.1 billion and has used it as a massive loan."

    California became so addicted to spending people's money, that, for years, it simply stopped sending notices to the rightful owners. ABC News obtained a 1996 internal memo in which the lawyer for the Bureau of Unclaimed Property argued against expanding programs to notify rightful owners. He wrote, "It could well result in additional claims of monies that would otherwise flow into the general fund."

    Seizing More Than Safe-Deposit Boxes

    It's not just safe-deposit boxes. A British man went to retire and discovered the $4 million in U.S. stock he had been counting on had been seized and sold for $200,000 years earlier -- even though he was in touch with the company about other matters.

    A Sacramento family lost out on railroad land rights their ancestors had owned for generations -- also sold off as unclaimed property.

    "If I had hung onto it, I would be a millionaire, multimillionaire," said John Whitley. "But that didn't happen because we didn't get to hold it."

    State Reforms

    California's unclaimed property program was so out of control that, last year, the courts issued injunctions barring the state from seizing any more property until it made reforms. Since then, Chiang has taken several steps to try to clean up the program.

    For example, the state now sends notices alerting citizens about unclaimed property before it is handed over to the state -- the only state to do so. Once unclaimed property is delivered to the state, it is now held for several months while the state tries to contact the owners, rather than it being immediately sold off or destroyed.

    Which raises the question, in the Internet era, is anybody really lost anymore? California and other states are just beginning to make use of modern databases that can find most anyone in minutes. Unfortunately, California only uses those databases to search after it has already seized a citizen's property.

    If California does get better at locating people, that could present another challenge. Remember, right now, the state spends the money.

    "It's like the last guy in line at a pizza parlor," Palmer criticized. "There is only so much pizza. At the end, when I get up to the counter to claim my pizza, there may be no pizza for me."

    California's fiscal problems are legendary and once again in the news, so it's reasonable to question whether the state can afford to repay its citizens if a bunch of them surface at once.

    "There is always going to be money to give the owners when they make their claim, " Chiang insisted. "I don't want my legacy to say I continued a broken program. I want my legacy to be 'this guy was the guy who truly cared about the people and returned their money.'"

    California is not the only state to come under fire for its handling of unclaimed property. In Delaware, unclaimed property is the third largest source of state revenue. Idaho recently passed an unprecedented law that says the state gets to keep unclaimed property permanently if the rightful owners don't claim it within 10 short years. And all 50 states pay private contractors 10 to 12 percent commissions to locate and seize accounts for them. It's an inherent conflict of interest: the more rightful owners are found, the less money the contractors make.

    Of course, there are some states who handle their people's property with respect. Oregon never takes title to unclaimed property. Instead, it holds it in a perpetual trust fund.

    Colorado uses the interest on its unclaimed property fund to pay for some state programs, but leaves the principal untouched.

    Missouri, Iowa and Kansas make extra efforts to reunite people with their property –even setting up booths at state fairs to get the word out. The State of Maryland actively compares the names on unclaimed accounts with state income tax records. If it finds a match, the state simply cuts a check and sends it to the citizen.

    Protecting Your Property

    So, the question for citizens is, how do you protect yourself?

    Make contact with your bank, your brokerage firm, etc. at least once a year, in a way that creates a paper trail. Make sure they have your current address.

    If you own stock, occasionally vote your proxies or take other steps to keep your stock ownership active. Stay in touch with your broker.

    Write a list of all your accounts and keep it with your will, so your heirs will know where to look.

    Consider insuring valuables even if you keep them in your safe-deposit box. That way, you're covered financially if the bank or state makes a mistake and empties your box. Plus, safe-deposit contents have been known to be destroyed by fire or flooding.

    An asteroid that exploded in the Earth’s atmosphere with the energy of three Hiroshima bombs this month has reignited fears about our planet’s defences against space impacts.
    On 8 October, the rock crashed into the atmosphere above South Sulawesi, Indonesia. The blast was heard by monitoring stations 10,000 miles away, according to a report by scientists at the University of Western Ontario.
    Scientists are concerned that it was not spotted by any telescopes, and that had it been larger it could have caused a disaster.
    The asteroid, estimated to have been around 10 metres (30ft) across, hit the atmosphere at an estimated 45,000mph. The sudden deceleration caused it to heat up rapidly and explode with the force of 50,000 tons of TNT.
    Luckily, due to the height of the explosion – estimated at between 15 and 20 km (nine to 12 miles) above sea level – no damage was caused on the ground.
    However, if the object had been slightly larger – 20 to 30 metres (60 to 90ft) across – it could easily have caused extensive damage and loss of life, say researchers.
    Very few objects smaller than 100 meters (300ft) across have been spotted and catalogued by astronomers.
    Tim Spahr, director of the Minor Planet Center in Cambridge, Massachusetts, warned that it was inevitable that minor asteroids would go unnoticed. He said: “If you want to find the smallest objects you have to build more, larger telescopes.
    “A survey that finds all of the 20-metre objects will cost probably multiple billions of dollars.”
    The fireball was spotted by locals in Indonesia, and a YouTube video taken that day “appears to show a large dust cloud consistent with a bright, daylight fireball”, according to the Ontario researchers.
    An asteroid or comet fragment around 60 meters across is believed to have been behind the Tunguska Event, a powerful explosion that took place over Russia in 1908. The blast has been estimated at equivalent to 10-15 million tons of TNT – enough to destroy a large city.
    The White House is to develop a policy on the space object impact threat by October next year.

    I hope you remember your quote judge, as you'll be hit over the head by that phrase over and over again.

    I will suggest again that Judge Williams reviews "Local Governments and Home Rule in South Carolina - A Citizens Guide" as published by the Strom Thurmond Institute at Clemson University. While there is no guarantee you will get a clue, there is hope that you will within those pages, sir.

In fact, here is a quote from the Judge (from the aforementioned article):

    ""I'm not moved particularly or influenced by the amount of money Mr. Ludwig may have made during his lifetime. I am moved and influenced by what he's done with it. You would expect a man to take care of his family, but it's evident to me that he's very unselfish in sharing what he has accomplished with others and that fact has probably influences me more than anything else in the sentence I'm about to impose," he said."

    So it's not just that he had money Judge Williams? He had money and he chose to spend it in a way in which you deemed it to be of greater benefit to the community? So money buys freedom? Is that what we are to take away from this, Judge Williams? I can drive my Maserati 185, and so long as I'm a generous person (including free home remodeling with my 100k sports car), I get a free pass?

    Pathetic.

    WYFF4 - Ludwig Judge Faces Scrutiny After Unrelated Ruling

    "Williams was also working at the Pickens County courthouse. On Thursday, he took a plea from George Westmoreland who faces two counts of committing a lewd act on a minor in 2006.

    Westmoreland's arrest warrants said that on two separate occasions, between July and August 2006, he touched a 9-year-old boy to gain sexual arousal. He was also charged with assault and battery of a high and aggravated nature (ABHAN) for allegedly touching a 16-year-old boy to gain sexual familiarity."

    So what did Judge "Patently Absurd" Williams do?

    "Court documents showed that on Thursday, Westmoreland entered an Alford Plea in which he maintained his innocence but acknowledged that a jury would likely convict him if the evidence were brought to trial.

    As part of the negotiated plea, the 13th Circuit Solicitor's Office dismissed the ABHAN charge and one of the lewd act charges. Instead of facing the second lewd act charge, Westmoreland pleaded guilty to the misdemeanor charge of ABHAN.

    Williams sentenced Westmoreland to one year of home incarceration followed by four years probation. As a condition of his probation, Westmoreland will not have to register as a sex offender. Also, while under home incarceration, he is allowed to travel for business while wearing a GPS monitor."

    I wish that last paragraph in bold was a clerical error. Sadly it is not. My question to "Patently Absurd" is this: Why would you let someone who is clearly a sex offender get off with a reduced sentence and somehow not force the individual to register as a sex offender?
